Racismo estrutural no sistema penal brasileiro: retroalimentação cíclica e encarceramento em massa

O racismo estrutural é uma política de opressão sistemática responsável por determinar diversas desigualdades. O presente artigo tem como objetivo analisar como o racismo estrutural, em suas intersecções com o classismo, leva ao encarceramento em massa pela atuação do sistema de justiça criminal. Para tanto, apresentamos o conceito de racismo e de classismo, o encarceramento em massa no Brasil e as principais teorias que tem buscado explicar o problema a partir dos marcadores de raça e classe. Por fim, destacamos o circuito de desvantagens acumulativas a que as pessoas negras e pobres estão sujeitas e o processo de retroalimentação cíclica para a condenação. O modelo apresentado congrega fatores sociais, jurídicos, psicológicos e estruturais, para explicar a sobrerrepresentação sociorracial de negros e pobres no sistema prisional. Ao expor o ciclo de processos que leva à condenação, esperamos fornecer alguns caminhos para intervenção e eventual atenuação do encarceramento em massa.
